I am having a lot of trouble sleeping right now...somebody just got busted by the cops. He was between my house and my neighbor's. There was a police helicopter right there. Light was shining through my mom's bedroom window practically. The sound obviously woke everyone up.
The guy walks up to my door asking to check our backyard. He's a cop, and he was a friend from high school. Small world...and right now I'm nearly having a stroke. They're gathering evidence or something right now...I think some are keeping vigil on my roof.
Just had to get some of this out of my system...hope it's not a complete waste of your time. (If this should be in spamz, someone please move it...I forgot to click on the spam forum)

That sucks. I had a similar thing happen a few weeks ago. They didn't actually catch the guy in my yard, but the helicoptors were flying around my whole neighbourhood and kept shining their light in my windows and stuff. I still don't know if they caught the guy...

Whoaaaaaa... I got woken up by cops this morning when a patrolling officer found our car doors open and the doors of our neighbor's cars open as well. I guess nothing was stolen but it was weird... who the hell would open all the doors (even the back door on our van) and just leave everything in the cars?

Someone who doesn't want anything in your car xD? Alas I didn't et a very good night's sleep...the cops left around 10:30 that morning. I don't think they'll be back anytime soon. Hopefully.

This happens to me all the time- I think its just a bunch of jerk kids looking for petty change for cigarettes and alcohol... I had a perfectly brand new awesome pair of bowling shoes- and there weren't even touched. I have to say I was slightly offended...
Buuut... other than that my neighbourhood's pretty quiet. Though the people that live behind us had their house set on fire, it was ruled to be arson, but they still haven't found the culprit(s). That was about 6 months ago I guess, and the house still hasn't finished being re-constructed. The whole inside burnt down, and 1/2 the outside was completely damaged, so they pretty well started from scratch...

STATEMENT OF FACTS
Defendant's Name: Eric L
Case No.: P279605
I respectfully submit this written declaration to the Court pursuant to CVC 40902. I plead Not Guilty to the charge of violating CVC 22350.
The facts of my case are as follows: While driving on Temple Avenue on 6/28/2005, I was stopped by a PPD Officer (I.D. NO. 30296) and was charged with violating CVC 22350. The Officer has alleged that I was driving 62mph in a 45mph zone based on LIDAR evidence. I believe that I was driving approximately 50-55mph at the time of my stop and that my speed was quite safe for the prevailing conditions.
The Basic Speed Law, CVC 22350 states: "No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of the highway, and in no event at a speed which endangers the safety of persons or property."
At the time of my stop, the road was dry and clear with light traffic. No persons or property were put at risk. As such, the Officer does not make a credible case that I was in violation of the Basic Speed Law.
Further, I believe that the posted speed of 45mph on Temple Avenue is artificially low, reflecting an out-of-date traffic and engineering survey and, as such, may constitute an illegal Speed Trap pursuant to CVC 40802(a)(2) which defines an illegal radar speed trap as: "A particular section of a highway with a...speed limit that is provided by this code...[which] limit is not justified by an engineering and traffic survey conducted within five years prior to the date of the alleged violation, and enforcement of the speed limit involves the use of radar or any other electronic device that measures the speed of moving objects." If the traffic survey on Temple Avenue is more than five years old, the officer's use of LIDAR to determine my speed was illegal.
When using radar evidence, the prosecution is required to prove that the use of radar is not an illegal speed trap. Speed Trap Evidence 40803(b) states: "In any prosecution under this code of a charge involving the speed of a vehicle, where enforcement involves the use of radar or other electronic devices which measure the speed of moving objects, the prosecution shall establish, as part of its prima facie case, that the evidence or testimony presented is not based upon a speed trap as defined in paragraph (2) of subdivision (a) of Section 40802."
If the prosecution does not attach proof with its written declaration (a certified copy of the speed survey) to establish as part of its prima facie case, that LIDAR is not an illegal Speed Trap, as they are required to do pursuant to CVC 40803(b), I trust the Court will rule the radar evidence inadmissible and dismiss my case pursuant to CVC 40805.
CVC 40805, Admission of Speed Trap Evidence, states:"Every court shall be without jurisdiction to render a judgment of conviction against any person for violation of this code involving the speed of a vehicle if the court admits any evidence or testimony secured in violation of, or which is inadmissible under this article."
I trust in the Court's fairness and ask that my citation be dismissed in the interest of justice.
If the court does not find in my favor in this case, I request a fine reduction and a Court assignment to attend traffic school.
I declare under penalty of perjury under the laws of the State of California that the foregoing is true and correct.

Did you ask them to show you the radar gun so that you could see the reading? They have to do that and if they refuse, they can throw out your case.
My ex boyfriend's dad is a cop, so I know a few tipsters like that.

In our country when a cop pulls you over and asks for your license, you slip him some cash along with the license. :p
Then he goes "I'll let you off with a warning." In the friendliest way possible and hands you back your license.

You in AZ right? I don't think any policy like that exists in CA.

It should be a nation wide policy, I'm not sure, but it's pretty wide spread. I learned that from a Military Cop and they tend to have the same regulations as most state police.
